Welcome to Churchory! These Terms of Service ("Terms") govern your use of the Churchory website, services, and applications — including the Churchory web application, the Churchory Mobile apps, and every church-branded ("white-labeled") app built on the Churchory platform and published under an individual church's own name (collectively, the "Service").
1. Acceptance of Terms
By accessing or using Churchory — including this website, the Churchory web application, Churchory Mobile, and any church-branded app published under a church's own name — you agree to be bound by these Terms. If you are using the Service on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Service
Churchory is a church community management platform that provides tools for small group management, attendance tracking, event planning and RSVPs, member care, volunteers and serving, and communication. The Service is provided to churches and their members, leaders, and administrators. You agree to use the Service in compliance with all applicable laws and for its intended purpose.
3. Church-Branded Apps
A church using Churchory may publish its own mobile app under its own name, icon, and colors, typically from its own Apple and Google developer accounts. These Terms govern the use of every such app, and each one links here.
A branded app is not separate software. It is the Service with a church's branding applied, built, hosted, updated, and operated by Churchory.
- The church's side. Your church is responsible for its own name, logo, marks, and the content it publishes in its app, and for keeping its developer accounts in good standing and complying with the app stores' program rules. By publishing a branded app, your church grants Churchory a limited, non-exclusive license to use its name, logo, and marks solely to build, publish, operate, and support that app. Content your church publishes must meet section 6 below and the app stores' guidelines.
- Privacy notices. Your church's branded listings link to Churchory's Privacy Policy. By publishing a branded app, your church confirms it has reviewed that policy and adopts it as the privacy notice for its app. Your church remains responsible for any further notice or consent its own circumstances require, and for the App Privacy and Data Safety disclosures it submits from its own developer accounts, which must match the practices described in that policy.
- Our side. The underlying software, platform, and functionality remain the property of Churchory and are licensed to your church for the term of its subscription — not sold or transferred. Updates and fixes ship to branded apps as they ship to ours.
- If it ends. If your church's subscription ends or these Terms are terminated, the branded app will stop functioning and your church is responsible for removing its listings from the app stores. Your church's right to export its data is unaffected; see section 7.
- For members. If you use a church-branded app, your agreement for the software itself is with Churchory under these Terms, alongside whatever relationship you have with your church. It is not with Apple or Google.
4. Mobile Apps and App Store Terms
Subject to these Terms, Churchory grants you a limited, non-exclusive, non-transferable, revocable license to install and use our mobile apps — Churchory Mobile and church-branded apps — on devices you own or control, as permitted by the applicable app store's usage rules. The following applies to apps you download from the Apple App Store:
- These Terms are between you and Churchory only, not with Apple. Churchory, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to furnish any maintenance or support for the app.
- To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the app; beyond that, Apple has no other warranty obligation whatsoever.
- Churchory, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims arising under consumer protection or similar legislation, and any third-party claim that the app infringes that party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app, such as your wireless carrier's terms of service.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
Apps downloaded from Google Play are additionally subject to the Google Play Terms of Service.
5. Accounts
- You must provide accurate, complete, and current information when creating an account, and keep it up to date.
- You are responsible for maintaining the security of your account and for all activity that occurs under it.
- Access to a church's workspace is managed by that church's administrators, who may grant or revoke roles and permissions.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful or unauthorized purpose, or in violation of these Terms.
- Access or attempt to access data belonging to another church or user without authorization.
- Interfere with or disrupt the integrity or performance of the Service.
- Use member information obtained through the Service for purposes unrelated to your church's ministry, including commercial solicitation.
7. Your Data
Your church retains ownership of the data it and its members submit to the Service. We process that data to provide the Service as described in our Privacy Policy. You are responsible for ensuring that data you submit about others (for example, household members) is provided with appropriate consent.
8. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Churchory and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Your church's own name, logo, and marks remain your church's; nothing in these Terms transfers them, and Churchory uses them only as described in section 3.
9. Service Availability and Changes
We work to keep the Service available and reliable, but the Service is provided "as is" and "as available" without warranties of any kind. We may modify, suspend, or discontinue features of the Service at any time.
10. Limitation of Liability
To the maximum extent permitted by law, in no event shall Churchory, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access to the Service, without prior notice or liability, for conduct that violates these Terms or is otherwise harmful to the Service or its users. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
